1. Bookings

All bookings will be regarded as provisional until a signed copy of these Terms & Conditions has been received from the client, along with a non-refundable deposit for the required products (as set out in Clause 2.4 below), and only if accepted by Here Comes The Hire will the booking be confirmed.


2. Payment and Security Deposit

2.1 All prices quoted by Here Comes The Hire may be amended when agreed with the Client and the Client will reasonably consider any errors or omissions or where an increase is caused by a change in the circumstances beyond the reasonable control of Here Comes The Hire.


2.2 Any query arising from an invoice or booking confirmation message must be notified to Here Comes The Hire in writing by the Client within 10 working days of the date of the invoice receipt. Failure to comply will render the full invoice payable on the due date.


2.3 It is strictly the responsibility of the representative of the Client confirming the booking to inform all relevant parties of the payment terms, as set out by Here Comes The Hire.


2.4 Deposit – A deposit of 50% of the total fee payable is due at the time of booking. The remaining 50% shall be known as the “balance”. Deposit payments (booking fees) are non-refundable and non-transferable (for postponement see Claus 3.5).


2.5 Balance Due – the balance of the total fee shall be payable 21 working days prior to the event date.


2.6 Additional Expenses – any additional expenses or fees resulting from any changes made by the Client, that have not been quoted in the agreed proposal but subsequently incurred by Here Comes The Hire, will be invoiced separately after the event.


2.7 Late Bookings – Should a booking be made within 21 days of the event date, payment in full will be required to secure the event.


2.8 Here Comes The Hire reserves the right to charge at the daily rate for any late returned equipment.


2.9 Methods of Payment - Bank transfer: Details available upon request to . Cash payments will not be accepted.


3.0 Security Deposit - An additional security deposit is required upon collection which is refunded as soon as the items are returned to us in a clean and acceptable condition. The value of the security deposit is based on your total hire cost and will be advised before booking. We accept security deposit payments by bank transfer or cash on collection. 


​3. Cancellation

3.1 This clause applies to the following: where the client (a) cancels the entire event, (b) cancels partial use of the facilities for the event or (c) reduces the duration of the event as a result of which the contracted value is reduced.


3.2 Should an event be cancelled by the Client, the following cancellation charges will apply and extend to the total charge. In addition, the client will settle any third party charges incurred by Here Comes The Hire on behalf of the client.

3.3 All cancellations must be received in writing from the client and will be deemed to take effect from the date of receipt.


3.4 Here Comes The Hire reserves the right to cancel the client’s booking if there has been a change of more than 40% of the client’s original contract. Written notification will be sent to the client.


3.5 Any postponements of confirmed and contracted business will be considered as a cancellation in accordance with the above cancellation clause. Here Comes The Hire is under no obligation to agree to a change in event date, it will do so solely at the discretion of Here Comes The Hire.  In the event that a revised event date is agreed, payments received by Here Comes The Hire from the client shall form a credit towards the future event.


3.6 Here Comes The Hire is unable to offer refunds for any items that are returned unused.


4. Equipment:

4.1 The hirer will confirm on taking possession of all equipment that it is in good working order and in undamaged condition. By accepting the goods, the hirer accepts that such agreement has been satisfied.


4.2. All equipment on hire remains the absolute property of Here Comes The Hire.


4.3. The hirer shall have no authority to transfer or otherwise part with possession of the equipment during the period of hire unless the express written consent of Here Comes The Hire is first obtained.


4.4 - Alternative Products. In the extremely rare circumstance that a product is lost/damaged during a previous hire, Here Comes The Hire reserve the right to substitute an item for an alternative but will discuss this with the client as soon as possible. If necessary we will withdraw our acceptance of your booking and refund in full. 


5. Collection of Goods

5.1 In general, Hire items will be collected by the customer from Here Comes The Hire premises at an agreed time. If delivery is arranged at an additional cost, Here Comes The Hire will agree with the client a time and place to deliver to. A nominated person will need to inspect and sign for the goods at the time of delivery.


5.2 Goods continue to be the client’s responsibility until they are returned to Here Comes The Hire or collected by Here Comes The Hire, therefore they should be kept clean, dry and secure until this time.


5.3 If Here Comes The Hire are collecting, all parts must be gathered together ready for Here Comes The Hire to collect, any additional time spent gathering products will incur additional fees. 


5.4 Any missing/damaged items will be chargeable, and for any items not returned clean a cleaning fee will apply, this will need to come out of the client’s security deposit. 


6. Damage or Loss to Equipment Hired:

6.1 It shall be the absolute responsibility of the hirer to ensure the safe keeping of equipment and the hirer will indemnify Here Comes The Hire in respect of any loss or damage however caused whilst in the hirer’s possession.


6.2 All damage or loss will be notified to Here Comes The Hire immediately (or as soon as practical) following which the goods must be returned to Here Comes The Hire for repair or replacement. The hirer is not permitted to carry out repairs to the damaged equipment and shall make no attempt to examine, diagnose, repair, or remove any part of the equipment hired.


6.3 The hirer shall be liable to pay the full cost of repair and / or replacement of any equipment lost or damaged beyond repair with reference to new equipment of the same or nearest available specification.


6.4 The client shall, in that eventuality, be liable for any and all costs or expenses incurred by Here Comes The Hire as a direct result of the postponement.


7. Liability

7.1 Here Comes The Hire shall not be liable under any circumstances whatsoever for losses incurred by the hirer due to faulty or non-functioning equipment during the period of hire. Here Comes The Hire will however take all steps to ensure that faulty equipment is replaced as soon as possible with either the same or similar equipment.


7.2 The hirer will indemnify Here Comes The Hire fully against any liabilities, demands, actions, claims or proceedings arising from or in connection with the equipment hired.


Here Comes The Hire or its employees or agents shall be liable for any damage, loss, delay or expenses caused to the client, its employees, agents, licensees or invitees or any other persons attending the event except insofar as it results from the negligence of Here Comes The Hire or breach of contract.


7.3 Here Comes The Hire reserve the right to determine the contract and recover any equipment hired in the event of bankruptcy, insolvency or liquidation of the hirer.


8. Force Majeure

Here Comes The Hire shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God (other than one arising from or related to directly or indirectly from volcanic ash), strikes, lock outs, accidents, war, fire, breakdown of plant or machinery, and Here Comes The Hire shall be entitled to a reasonable extension of its obligations.
